1) Scope of Application
1.1 These General Terms and Conditions (hereinafter referred to as "GTC") of Nicola Steuck (hereinafter referred to as "Seller") apply to all contracts between a consumer or trader (hereinafter referred to as "Client") and the Seller regarding goods and/or services displayed in the Seller’s online shop. Any terms and conditions of the Client are hereby excluded unless otherwise agreed.
1.2 These GTC also apply to contracts for the delivery of vouchers, unless expressly stated otherwise.
1.3 A "consumer" under these GTC is any natural person entering into a legal transaction for purposes that are not primarily commercial or self-employed.
1.4 A "trader" under these GTC is a natural or legal person or a partnership with legal capacity acting in the course of their commercial or independent professional activity when entering into a legal transaction.

2) Conclusion of the Contract
2.1 The product descriptions in the Seller’s online shop do not constitute binding offers but serve as an invitation for the Client to submit a binding offer.
2.2 The Client can submit an offer using the online order form in the Seller’s online shop. By placing the selected goods and/or services in the virtual shopping cart, completing the ordering process, and clicking the button to finalize the order, the Client submits a legally binding offer to purchase the goods and/or services in the shopping cart.
2.3 The Seller may accept the Client’s offer within five days by:

  • Sending a written order confirmation (e.g., via email or fax),

  • Delivering the ordered goods, or

  • Requesting payment from the Client.
    If multiple alternatives apply, the contract is concluded when the first of these occurs. If the Seller does not accept the offer within this period, it is considered rejected, and the Client is no longer bound by their offer.
    2.4 If the Client selects a payment method offered by PayPal, payment processing is handled by PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg, under the PayPal Terms of Use. The Seller accepts the Client’s offer at the moment the Client clicks the button finalizing the order process.
    2.5 After the contract is concluded, the Seller stores the contract text and sends it to the Client in text form (e.g., via email). If the Client has a user account, the order data can be accessed via their password-protected account.
    2.6 Before submitting a binding order, the Client can review and correct any input errors using standard keyboard and mouse functions. The browser’s zoom function may help identify errors.
    2.7 The contract can be concluded in German or English.
    2.8 Order processing and communication typically occur via email and automated systems. The Client must ensure that their provided email address is accurate and that emails from the Seller or third parties involved in order processing are not blocked by spam filters.

3) Right to Cancel
3.1 Consumers have the right to cancel their order.
3.2 Detailed information about the right to cancel is provided in the Seller’s cancellation policy.

4) Prices and Payment Conditions
4.1 Unless otherwise stated, prices include statutory sales tax. Additional delivery costs, if applicable, are listed separately in the product description.
4.2 Payment can be made using any of the methods specified in the Seller’s online shop.
4.3 For credit card payments via Secupay, the invoice amount is due immediately upon contract conclusion. Payment processing is handled by secupay AG, Goethestr. 6, 01896 Pulsnitz. The Seller assigns the payment claim to secupay AG, and payment can only be made to secupay AG with debt-discharging effect. The credit card is debited immediately after the order is placed. The Seller remains responsible for general customer inquiries.
4.4 For payments via "Shopify Payments," payment processing is handled by Shopify International Limited, Victoria Buildings, 2nd Floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland. Additional payment terms may apply, depending on the payment method selected.
4.5 For "immediate bank transfer" payments, processing is handled by SOFORT GmbH, Theresienhöhe 12, 80339 Munich. The Client must have an online banking account activated for this service and confirm the payment during the process.
4.6 For payments via Klarna Invoice Purchase or Klarna Installment Purchase, processing is handled by Klarna AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden. Additional terms and conditions apply, as outlined in the Seller’s payment information.

5) Shipment and Delivery Conditions
5.1 Delivery is made to the address specified by the Client during the ordering process. If PayPal is selected as the payment method, the delivery address registered with PayPal is used.
5.2 If delivery to the Client fails and the goods are returned to the Seller, the Client bears the costs of the unsuccessful delivery, unless the cancellation right is exercised, the delivery failure is beyond the Client’s control, or the Client is temporarily unable to receive the goods.
5.3 Personal collection of goods is not available.
5.4 The Seller may withdraw from the contract if incorrect or improper self-supply occurs, provided the Seller is not responsible for the non-supply and has made reasonable efforts to obtain the goods. The Client will be informed of any unavailability and offered a replacement.

6) Reservation of Proprietary Rights
The Seller retains ownership of delivered goods until the purchase price is paid in full.

7) Warranty
7.1 Unless otherwise stated, statutory warranty provisions apply. For traders:

  • The Seller may choose the type of subsequent performance,

  • For new goods, the warranty period is one year from delivery,

  • For used goods, warranty rights are excluded,

  • The warranty period does not restart if a replacement delivery is made.
    7.2 These limitations do not apply to claims for damages, fraudulent concealment of defects, or goods used in construction.
    7.3 Traders must inspect goods and notify the Seller of defects promptly. Failure to do so results in the goods being deemed approved.
    7.4 Consumers must notify the carrier of obvious transport damages and inform the Seller. Failure to do so does not affect statutory or contractual claims.
    7.5 The Seller is not liable for defects in telecommunications services provided by third-party service providers.

8) Redemption of Campaign Vouchers
8.1 Campaign vouchers issued by the Seller are valid only within the specified period and can only be redeemed in the Seller’s online shop.
8.2 Certain products may be excluded from voucher campaigns.
8.3 Only one campaign voucher can be used per order.
8.4 The order value must meet or exceed the voucher amount. Remaining balances are not refunded.
8.5 If the voucher does not cover the full order amount, the Client must pay the difference using another payment method.
8.6 Voucher credits are non-refundable and do not accrue interest.
8.7 Vouchers are not refunded if the Client cancels the order and returns goods paid for with the voucher.
8.8 Vouchers are transferable. The Seller may discharge obligations by delivering to the voucher holder, unless the Seller knows or should know that the holder is not entitled to the voucher.

9) Applicable Law
9.1 German law applies to all legal relationships between the parties, excluding international purchase laws. For consumers, this applies only if mandatory protections under their country of residence are not affected.
9.2 The right of cancellation does not apply to consumers outside the EU whose residence and delivery address are outside the EU at the time of contract conclusion.

10) Alternative Dispute Resolution
10.1 The EU Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr.
10.2 The Seller is not obligated to participate in alternative dispute resolution procedures.
